Are prediction markets legal in Massachusetts?

Yes, but there is ongoing litigation addressing that very question. United States law (the Commodity Exchange Act and the Dodd-Frank Act) permits prediction market trading on exchanges registered with the Commodity Futures Trading Commission (CFTC), but Massachusetts officials have disputed the legality of sports event contracts in the state.

Massachusetts Attorney General Andrea Joy Campbell sued Kalshi in state court over those sports event contracts in September 2025, arguing that they represented illegal gambling under the state’s Sports Wagering Act (Chapter 23N). In January 2026, the court granted Campbell’s request for an injunction banning Kalshi from offering sports event contracts to people in Massachusetts.

However, that injunction has been stayed pending Kalshi’s appeal to the Massachusetts Supreme Judicial Court. It’s important for people in Massachusetts to note that the dispute only involves sports event contracts, meaning that MA officials have not yet challenged the legality of non-sports prediction markets.

The Massachusetts Supreme Judicial Court will determine the status of sports event contracts in the state, and federal court cases around the United States will also impact the availability of these markets. For the time being, though, MA prediction markets face no legal restrictions on the types of contracts that they can offer.

Example: Trading on New England Patriots futures

At the time of this writing, the “yes” side of the Patriots winning at least 10 games during the 2026-27 season traded for $0.56 at Kalshi. If the Patriots complete the regular season with nine or fewer wins, that contract settles at $0, representing a loss for people in the market.

If the Patriots finish the season with at least 10 wins, the market settles at $1. That would mean a profit of $0.44 for each contract for people who bought in at $0.56.

Traders are not bound to wait out the contract settlement, though, and are free to take advantage of favorable fluctuations. For example, suppose that the Patriots get off to a hot start and win their first three regular season games, meaning they would only need to win half of their remaining 14 games to get to that 10-win threshold.

In that case, the contract price could rise to reflect the increased demand for the market. If it were to rise to $0.86, for example, people who bought in at $0.56 could sell at that point and realize a $0.30 profit. In doing so, they would sacrifice the other $0.14 of potential profit to get the guaranteed $0.30 in profit.

How fees work at MA prediction markets

Bay Staters interested in Patriots or Red Sox futures will find plenty of markets on MA prediction markets, but exchanges also charge fees that vary by platform and by contract price. Check each platform’s fee schedule before you trade, since the rules aren’t the same everywhere.

Fees are typically highest on contracts trading near the middle of the price range and taper off toward the extremes. A contract priced near $0.50 reflects the most uncertainty, so exchanges charge more to facilitate that trade; a contract priced near $0.10 or $0.90 reflects a market that has largely made up its mind, so the fee is smaller.

That structure matters more than it looks. Fees are typically assessed as a small percentage of the contract’s price rather than a flat percentage of your total spend, so the profit margin they eat into shifts depending on where you’re trading. A contract at $0.10 has far more room to run if you’re right — a $0.90 payout on a winning $0.10 contract — but a small fee still claims a larger share of that bigger potential profit than the same fee would on a $0.60 contract with less room to climb.

Kalshi and Polymarket do not have such licenses to try to protect, so they have instead gone the litigation route to preserve their ability to offer sports event contracts in MA. Ultimately, the courts will determine whether MA can regulate sports event contracts like sports bets.

Prediction markets continue to evolve

Massachusetts has been an active jurisdiction for the legal dispute over sports event contracts, featuring cases in federal and state courts. At the time of this writing, MA Attorney General Andrea Joy Campbell has secured a preliminary injunction barring prediction markets from offering sports event contracts in the state, but that injunction is not in effect pending an appeal by Kalshi.

While that stay of the injunction remains valid, prediction market activity remains solely under the supervision of the CFTC, and sports event contracts remain available on the exchanges that have chosen to offer them in MA. It’s important to note that Campbell has not challenged the legality of all prediction market trading, merely sports event contracts.

A successful appeal by Kalshi or a lifting of that stay could quickly change the status quo in terms of sports event contracts in MA. That resembles the state of prediction market trading, especially within the context of sports event contracts, across the greater nation.

The CFTC, exchanges, state governments, and tribal authorities have lodged several lawsuits across the nation disputing attempts to regulate event contract trading and the legality of such trading.
