Are prediction markets legal in Louisiana?

Yes, provided that users meet all eligibility requirements and trade with an exchange that is registered with the US Commodity Futures Trading Commission (CFTC). The CFTC is the federal agency that regulates exchanges across the US, including in Louisiana. Event contracts are classified as swaps under the Commodity Exchange Act, which is why federal law preempts state gambling regulation for CFTC-registered platforms.

While other states have challenged the legality of prediction market trading within their borders, LA officials have not moved in that direction as of the time of this writing. The only action of that nature that has emanated from the state to date is a December 2025 advisory notice from the Louisiana Gaming Control Board (LGCB).

The LGCB advised companies that hold sports wagering licenses in LA that they could jeopardize those licenses if they offer prediction markets in the state. However, the LGCB has not moved to actually enforce that premise yet.

Amid that non-activity in Louisiana, another lawsuit brought by prediction market exchange operator Kalshi against New Jersey officials might have an impact on the future of LA prediction markets. Those officials are in the process of appealing an injunction against them to the US Supreme Court.

A Supreme Court decision will have ramifications for prediction markets in every part of the US, Louisiana included. Louisianans should watch to see if the Supreme Court agrees to review the case for that reason.

Polymarket is moving quickly to post market volume that competes with Kalshi in LA, and that’s a great thing for Louisianans because it means that they can find an unmatched variety of markets on Polymarket. However, many of Polymarket’s markets still lack the depth that Kalshi contracts provide, especially in regard to less popular and publicized events.

The rapid expansion of markets at Polymarket includes contracts on New Orleans Pelicans futures and games. Polymarket users can currently trade on whether New Orleans will sign Trey Murphy III and whether the Pelicans will qualify for the playoffs for the 2026-27 National Basketball Association season, for example.

FanDuel

Example: Trading on New Orleans Saints futures

Kalshi currently has a live market on which team will win the National Football Conference’s South Division title in the 2026-27 NFL season. Traders can buy contracts for New Orleans on the “yes” side of that market for $0.29 and/or the “no” side for $0.73 right now.

If you were to buy into either side of that market and your prediction turned out to be right, then Kalshi would give you a positive settlement of $1 per contract when the season ends. That could mean a profit of $0.71 per contract on the yes side ($1.00-$0.29=$0.71) or $0.27 ($1.00-$0.73=$0.27) per contract on the no side if you got in at the current prices.

You don’t have to wait until the season ends to potentially profit from your holdings, though. You have the option to sell before the contracts resolve and that can allow you to reduce your risk in exchange for sacrificing some potential profit.

For instance, if the Saints won their first two regular-season games, demand for the yes side of this market could spike, and the price of those contracts would rise in accordance. If the contract price rose to $0.49, people who bought those contracts at $0.29 could get a profit of $0.20 per contract by selling at that point.

How fees work

Fans of the Saints, Pelicans, or LSU will find plenty of markets on LA prediction markets, but exchanges also charge fees that vary by platform and by contract price. Check each platform’s fee schedule before you trade, since the rules aren’t the same everywhere.

Fees are typically highest on contracts trading near the middle of the price range and taper off toward the extremes. A contract priced near $0.50 reflects the most uncertainty, so exchanges charge more to facilitate that trade; a contract priced near $0.10 or $0.90 reflects a market that has largely made up its mind, so the fee is smaller.

That structure matters more than it looks. Fees are typically assessed as a small percentage of the contract’s price rather than a flat percentage of your total spend, so the profit margin they eat into shifts depending on where you’re trading. A contract at $0.10 has far more room to run if you’re right — a $0.90 payout on a winning $0.10 contract — but a small fee still claims a larger share of that bigger potential profit than the same fee would on a $0.60 contract with less room to climb.

The case most likely to do so is Kalshi v. Flaherty. Currently, the New Jersey officials who are the defendants in that civil lawsuit are preparing to ask the US Supreme Court to review part of that case.

Because the US Supreme Court is the highest in the land, any decision from those justices would have ramifications for the entire country, Louisiana included. The issues that would be before the court should the justices agree to hear the case include whether exchanges can offer sports event contracts.
