Are prediction markets legal in Virginia?
Yes, prediction markets are legal to use in Virginia. If you’re trading on platforms like Kalshi or the US version of Polymarket, you’re using exchanges that are registered with and regulated by the Commodity Futures Trading Commission (CFTC) at the federal level. Virginia hasn’t sued, blocked, or taken any action against these platforms, unlike some other states.
Lawmakers did try to create a new statewide Gaming Commission (HB 271) that would eventually study prediction markets, but the Senate Finance and Appropriations Committee voted in March 2026 to push that bill back to 2027, so nothing changes for now. That means there’s no Virginia-specific tax or licensing rule on these markets today.
That said, the platforms police themselves closely. In April 2026, Kalshi banned Virginia US Senate candidate Mark Moran for five years and fined him $6,229 after he placed a $100 trade on his own race, violating rules against insider trading on your own election. Moran repeatedly refused to settle with Kalshi’s compliance team. So while Virginia law stays hands-off, the platforms still enforce their own strict rules.
