Are prediction markets legal in Tennessee?
The legal status of sports contracts is contested. On Sept. 25, 2026, the Sixth Circuit vacated Kalshi’s Tennessee preliminary injunction, allowing the state to enforce its sports wagering laws while the case continues. Sixth Circuit opinion.
Recently, Tennessee regulators tried to shut down the sports side of these platforms. The state's Sports Wagering Council sent out cease-and-desist letters, claiming sports prediction contracts were just unlicensed sports betting. Kalshi won a preliminary injunction in February 2026, but the Sixth Circuit vacated it on Sept. 25.
The appellate ruling concerned sports contracts and a preliminary injunction, not every category of event contract.
Also, you should know about a new state law (SB 1992) that took effect on July 1, 2026. It is a felony under this Act to benefit from a prediction market contract if you do anything to influence the outcome of that event. This rule is narrowly targeted at individual bad actors who are engaging in match-fixing or market manipulation. It regulates the conduct of the traders, not the legality of the platforms themselves.
TN prediction market apps reviewed
Tennessee residents can access several prediction-market apps in 2026, but the available markets differ sharply by platform. Sports access differs by operator: OG’s published restrictions do not list Tennessee, FanDuel Predicts and DraftKings Predictions exclude sports contracts here, and public listings do not establish Tennessee trading access on Kalshi or Polymarket US.
- Kalshi: Sports markets listed; Tennessee trading access not established
- Polymarket: Best for the widest range of headline-driven topics
- FanDuel Predicts: Best for non-sports markets in a familiar app
- OG: Tennessee is not on OG’s published sports-restriction list
- DKeX: Best for existing DraftKings customers
Kalshi
Election markets listed; Tennessee sports access unconfirmed
Kalshi lists sports, politics, business and entertainment markets, but Tennessee sports-contract access may change following the Sept. 25 appellate ruling. Users buy Yes or No contracts rather than traditional point spreads or moneylines.
Kalshi lists a Tennessee governor race market. Its sports listings do not establish that Tennessee users can trade Titans, Grizzlies, Predators or Vols contracts; their public sports listings do not confirm Tennessee trading access.

Polymarket
Best for the widest range of headline-driven topics
Polymarket US and the global Polymarket site are separate products. The global site lists sports, politics, business, culture and technology markets, but those listings do not establish what Tennessee users can trade on Polymarket US.
Tennessee users should use Polymarket US, not the global site. Its US sports listings alone do not establish whether Tennessee residents can trade Titans or Vols contracts.

FanDuel Predicts
Best for non-sports markets in a familiar app
FanDuel Predicts is a simple choice for existing FanDuel users. It features markets for Tennessee users on finance, the economy, commodities, and other non-sports topics.
FanDuel Predicts does not offer sports contracts in Tennessee: it limits sports contracts to states without legal online sports betting, and Tennessee licenses online sportsbooks. That means no Titans, Grizzlies, Predators or Vols sports contracts on FanDuel Predicts. See FanDuel’s product announcement and the Tennessee Sports Wagering Council’s licensee list.

OG Predictions
Best for social, sports-focused trading
OG Predictions is a sports, politics, economic and culture markets with a more community feel. OG’s published state-restrictions list does not name Tennessee among states restricted from trading sports contracts, as checked Oct. 15, 2026.
OG lists sports and other event contracts; its state-restrictions notice is stronger evidence for Tennessee access than a nationally visible market listing. Still, OG is newer than Kalshi, so smaller markets may have fewer traders and not every local event will be available.

DKeX
Best for existing DraftKings customers
DKeX powers DraftKings Predictions, which is built into the DraftKings Sports & Casino app. If you are a Tennessee user and already have a DraftKings account, this will be your easiest option.
The biggest downside is that sports markets are not yet available in Tennessee. DraftKings Predictions users can look for non-sports contracts, but they can’t trade Titans, Grizzlies, Predators or Vols outcomes.

How to trade prediction markets in Tennessee
If you have ever signed up for a legal sports betting app in Tennessee, getting started with a prediction market will feel very familiar. The registration and verification flows follow the same standard steps you are used to, with just a few small differences when you fund and trade.
Here is how to get set up and place your first trade from anywhere in the Volunteer State:
- Choose your platform
Start by picking an app that accepts Tennessee users and matches what you want to trade. You will want to compare market liquidity (how fast trades fill), transaction fees, and available categories. Most importantly, check whether the platform currently offers sports contracts in Tennessee or focuses strictly on politics, finance, and pop culture. - Complete identity verification
Because these platforms operate under US regulatory standards, you must complete standard identity verification (KYC) before you can deposit or withdraw money. Have handy your driver’s license or state ID, as well as basic information, such as your legal name, home address and the last four digits of your Social Security number. - Enter a promo code
Find a promo code field on registration. Some platforms will automatically give you a welcome bonus or fee reduction when you use our links, while others will require you to manually enter a specific code before you finish signing up. - Fund your account
Head to the cashier to make your first deposit. Most federally regulated platforms accept traditional payment methods like debit cards, instant bank transfers (ACH), and wire transfers. - Start trading event contracts
Browse the open markets and select an event. Prediction contracts are simple "Yes" or "No" questions priced between $0.01 and $1.00 per share. The share price represents the crowd's estimated probability of the event happening, for example, a "Yes" share at $0.65 means the market sees a 65% chance of that outcome. If you believe the event will occur, buy "Yes"; if not, buy "No." You can hold your shares until the event resolves for $1.00 or sell early to take profits or cut losses. - Withdraw your earnings
To withdraw funds, go to the cashier section, choose your preferred withdrawal method and type in the amount. Standard ACH transfers typically hit your bank account in one to three business days, while debit and crypto withdrawals can settle much quicker.
Example: Trading on Tennessee Titans futures
Let's walk through exactly how this works using a hypothetical trade on the Tennessee Titans' 2026 regular-season win total.
Suppose a contract on whether the Titans win seven or more games costs $0.48 for Yes. This is an illustrative price, not a current quote.
If you buy a "Yes" position at $0.48 and the Titans finish the season with seven or more wins, the contract settles at $1.00. You keep your original $0.48 and make a $0.52 profit per contract. If they finish with six or fewer wins, the contract settles at $0.00, and you lose your $0.48.
The massive advantage here is that you don't have to wait until January to get paid. The price of your contract will evolve every single week based on how the team plays and what other traders think. Let's say the Titans open their season with a hot 2-0 start by beating the Jets and the Eagles. The price for that "Yes" contract might immediately jump from $0.48 up to $0.75. You can sell your position right then and there to lock in a guaranteed profit, completely avoiding the risk of a late-season collapse. Or if the team gets off to a bad start and the price drops to $0.20, you can sell out early and get some of your cash back, rather than riding the team all the way to zero.
How fees work
Before you start trading, we need to talk about what these platforms actually charge you. Because you are trading on an exchange rather than betting against a house, you will encounter transaction fees.
Every platform uses a slightly different fee structure, but on the major regulated exchanges, you are looking exclusively at trading fees charged when you buy or sell. Neither Kalshi nor Polymarket US charges a settlement fee when your contract pays out.
The math here is crucial because fees are calculated on a curve, not a flat rate, and they impact cheap contracts disproportionately. Both platforms charge you the most when the market is at a $0.50 coin-flip, and the fees shrink as outcomes become more certain. But the fine print at the extremes is where your margin gets eaten.
For example, Kalshi's fee formula rounds up to the nearest cent. If you buy a single "Yes" share for a longshot outcome at $0.01, the math dictates a fraction of a penny, but Kalshi rounds it up to $0.01. You end up paying a massive 100% fee on your initial investment just to place the trade. By comparison, buying 100 contracts at $0.50 hits Kalshi's fee ceiling of $1.75.
Finding the cheapest exchange is one of the easiest ways to protect your bankroll. Based on current fee schedules, Polymarket US runs a nearly identical formula to Kalshi's, peaking around $1.74 per 100 contracts at the 50-cent mark. Despite Polymarket's reputation as the low-cost option, the two platforms are effectively neck-and-neck on fees today.
To visualize exactly how these costs eat into your specific trades across different apps in more detail, run your numbers through our prediction market fee calculator. If you want a full breakdown of every platform's exact pricing model, check out our comprehensive prediction market fees page.
Upcoming sports events to trade on in Tennessee
In prediction markets, event-contract prices don't just sit still until the final whistle. They shift constantly in response to breaking news, injury reports, weather changes, and real-time public sentiment.
In a hypothetical Volunteers game market, an injury report or an early turnover could move the price of a Vols win contract. Unlike a static pregame line, you may be able to sell a position before the game ends.
The same logic applies to season-long futures for the Tennessee Titans. If the Titans open their season with a strong showing, their "To Make the Playoffs" contract price will climb. You can sell your shares right then to lock in a profit, completely avoiding the risk of a late-season collapse when their schedule gets tougher. Trading local markets feels entirely different from traditional betting because your read on local momentum lets you capitalize on price swings before the event even finishes.
The live table below shows listed sports markets; check each app for current Tennessee availability:
TN prediction markets vs. sports betting
Tennessee runs both products side by side, under different regulators, and they work differently under the hood.
- Market structure, peer-to-peer vs. the house: On a prediction market, you're trading a contract against other traders; on a sportsbook, you're betting against the book itself.
- How pricing/odds are determined: Prediction-market prices move with supply and demand from other traders; sportsbook lines are set by the operator.
- How platforms make money: Prediction markets charge transaction and trading fees; sportsbooks build their margin into the odds as vig.
- Trading flexibility and legality: You can enter and exit a prediction-market position before it settles; a sportsbook bet is locked in the moment you place it. Tennessee has both products, regulated by different bodies: the CFTC federally for event contracts, and the state's own sports wagering council for sportsbooks.
- Key difference: one lets you trade your way out of a position before the outcome is known; the other locks your money in until the final whistle.
What markets can you trade on in Tennessee?
Prediction markets go well beyond sports, and each category has a clear front-runner.
- Sports prediction markets: OG’s published restrictions do not list Tennessee as sports-restricted (checked Oct. 15, 2026). Kalshi and Polymarket US list sports markets, but those public listings do not establish Tennessee trading access. FanDuel Predicts and DraftKings Predictions do not offer sports contracts in Tennessee.
- Political and election markets: Kalshi lists a Tennessee governor GOP nominee contract, with Marsha Blackburn favored after her primary win. Polymarket runs parallel governor and Senate race markets for Tennessee. Best platform: Kalshi
- Economic indicator markets: Kalshi and Polymarket both list contracts on every scheduled Fed meeting, such as whether the Fed will cut rates at a future meeting. FanDuel Predicts offers similar finance-focused, non-sports contracts nationwide. Best platform: FanDuel Predicts
- Cryptocurrency price predictions: Polymarket has live Bitcoin price-target contracts. Markets include Bitcoin hitting $150,000 or remaining under $100,000 in 2026. Best platform: Polymarket
- Entertainment and culture markets: Kalshi and Polymarket both ran heavy-volume Oscars Best Picture and Best Actor/Actress contracts this year, plus Grammy and reality TV markets like Big Brother eviction outcomes. OG also lists culture contracts, including Oscars Best Picture. Best platform: Kalshi
Tennessee-specific rules for prediction markets
The legal split between event contracts and sportsbook wagering carries through into the fine print, too.
- Age requirements: Prediction markets are typically open to traders 18 and up, while Tennessee's regulated sports betting requires you to be 21, a real gap if you're a younger trader who can access one market but not the other.
- Tax treatment of winnings: Trading gains are generally taxable on your federal return, but the IRS hasn't issued guidance specific to prediction-market contracts, so treatment can vary. Tennessee has no state income tax on wages, but confirm separately how that applies to trading gains specifically before you file.
- Tennessee's manipulation law: SB 1992 makes it a Class E felony to profit from a contract you took action to manipulate, covered in full above, but worth flagging again here since it's unique to Tennessee among the states we cover.
- Settlement rules: How and when a contract resolves determines exactly when you get paid and matters because disputed or ambiguous outcomes can delay settlement or trigger a platform review before funds move.
How Tennessee works between products
If you're tracking how prediction markets fit into our state's broader landscape, you should know we currently have two parallel systems running at once. Tennessee already boasts a fully legal, regulated online sports betting market, which operates entirely separate from the ongoing prediction market litigation.
The core legal dispute centers on a jurisdictional question. State regulators argue that sports event contracts are simply unlicensed sports betting. Kalshi argues these contracts are financial derivatives regulated exclusively by the federal Commodity Exchange Act.
On Sept. 25, 2026, the Sixth Circuit vacated Kalshi’s Tennessee preliminary injunction and remanded the case. The state is no longer blocked by that injunction from enforcing its sports wagering laws against Kalshi. Read the opinion.
Crucially, you shouldn't assume broad parity across every platform. With Kalshi’s injunction vacated, platforms tied to traditional sportsbooks play it safer. We have found that both FanDuel Predicts and DKeX routinely exclude sports contracts in states with existing legal sportsbooks. Because Tennessee falls into that category, you won't necessarily find the same sports-contract menu on every app on this page.
Prediction markets continue to evolve
Tennessee's own fight is far from over. The Sixth Circuit vacated Kalshi’s Tennessee preliminary injunction on Sept. 25, 2026, and remanded the case. Read the opinion.
The Digital Chamber filed a Sixth Circuit amicus brief on June 25, 2026, backing Kalshi against Tennessee's appeal, arguing the state's legal theory could threaten federally regulated derivatives well beyond sports contracts.
This local showdown sits inside a much bigger national pattern. The Commodity Futures Trading Commission (CFTC) has taken an increasingly active role in defending federal jurisdiction over event contracts through guidance and its own amicus filings. At the same time, a growing list of states, including Nevada, Maryland, Arizona, Illinois, Michigan, Massachusetts, Ohio, Connecticut, and New Jersey, are running their own legal challenges against Kalshi at varying stages of litigation.
State regulators and tribal gaming interests remain the most consistent opponents of prediction markets expanding into sports contracts. They argue these markets function as unlicensed sports betting and should remain under local control. Conversely, the platforms argue their contracts are financial derivatives that belong exclusively under federal oversight.
While the battle over sports contracts plays out in the courts, non-sports categories like politics, economics, and pop culture continue to largely avoid the fight altogether. We will keep this guide updated as Tennessee's legal landscape continues to take shape.

Things to know before you trade in Tennessee
- Legal sports betting also exists here: It's a separate product, contracts trade peer-to-peer under CFTC oversight, while sportsbooks take your bet directly under a state license, and the age minimums differ (18+ vs. 21+).
- Prediction markets are different: You're trading event contracts with prices set by other traders, not fixed odds set by an operator.
- Tennessee now criminalizes manipulation directly: SB 1992 makes it a felony to profit from a contract tied to an outcome you took action to influence.
- Sports-contract availability varies by platform: Kalshi’s Tennessee injunction was vacated Sept. 25; don’t assume any platform offers the same sports lineup here. Also note that FanDuel Predicts and DKeX do not offer sports markets.
- The legal fight isn't fully over: The Sixth Circuit vacated Kalshi’s Tennessee injunction on Sept. 25, 2026; litigation continues, and platform access may change.
