Are prediction markets legal in Oregon?

Yes, but you need to ensure that the exchange that you are trying to use is registered with the United States Commodity Futures Trading Commission (CFTC) and that you meet all the eligibility requirements of the platform. These rules usually include an age minimum of 18 and may preclude certain types of trades for specific individuals. 

Oregon’s state government has not to date taken any action to dispute the legality of prediction market trading, but litigation initiated in other US states may have an impact on this activity in OR. The lawsuits most capable of doing so involve disputes between Kalshi and officials in Nevada and New Jersey.

Nevada has won an important victory against Kalshi at the US Ninth Circuit Court of Appeals. A three-member panel from that court opined that trading sports event contracts on Kalshi is tantamount to sports wagering and that Nevada has sovereignty over that activity within its borders.

This has relevance for people in OR because Oregon is also within the Ninth Circuit’s jurisdiction. However, Oregon authorities have yet to act on this issue.

Private citizens in OR have not been as passive on the issue, though. They initiated a class-action lawsuit in February that alleged that Kalshi’s exchange violates the state’s gambling laws. That case, Reynolds v. Kalshi, was transferred to the US District Court for the Southern District of New York in June, and there have been no updates in the dispute since. 

The New Jersey dispute of note involves an opposing opinion from the Third Circuit, which held that they may not enforce that state’s gambling laws against Kalshi’s sports event contracts. New Jersey officials have since petitioned the US Supreme Court for review of that ruling.

How to trade prediction markets in Oregon

Trading event contracts in OR is simple and takes place completely online through exchanges’ apps and websites. Online sports wagering has been legal in Oregon since 2019, and people who have participated in that activity will see how the six-step process of trading event contracts is similar, although legally distinct.

  1. Select an exchange: Don’t go any further before you ensure that the exchange is in good standing with the CFTC and accepts trades from people in OR. It’s wise to compare fees and make sure that the exchange offers the markets you’re interested in, too.
  2. Share your account details: CFTC regulations require exchanges to collect contact and identity details from every potential trader. These details usually include your date of birth, legal name, and residential address.

  5. Search the available markets: Use the app or website search function to look for markets that you are familiar with and compare the prices of the contracts plus settlement rules before you buy in.
  6. Claim your earnings: You can choose how to proceed with any positive settlements that you might receive, either using the funds to trade with or withdrawing them as cash. Pay attention to exchange policies on payment types for withdrawal requests, as the source you choose may affect how long it takes to receive the funds.

Example: Trading Portland Thorns FC futures

Kalshi has a market on which club will win the National Women’s Soccer League championship for the 2026 season with contracts available on both sides of the premise for every club in the league. At this time, the “yes” side on Portland is trading at $0.13, while the “no” side is trading at $0.99.

Using these contracts as an example, people who buy into the yes side will get a positive settlement of $1 per contract if the Thorns win the championship. People who buy into the no side get the same settlement if any other club wins that title.

That would mean a potential profit of $0.87 per contract for people on the yes side ($1.00-$0.13=$0.87) at the current price and a potential profit of $0.01 per contract for people on the no side. That is, if the traders were to hold onto those contracts through the resolution of the market, though.

People in OR wouldn’t have to stay in the market that long if they see an opportunity to exit their position earlier. If the Thorns were to post a long point streak, for example, the price on the yes market might escalate and make it worth selling.

Contract holders may sacrifice some potential profit to sell before the market resolves but they also alleviate themselves from taking the risk that comes with holding their position over the course of months. This is an example of how there is always risk involved in prediction market trading. 

How fees work

Oregon prediction markets are peer-to-peer exchanges, so fees are their main source of revenue — what operators charge for facilitating the contract between you and the trader on the other side. Fees vary by platform and by contract price. Check each platform’s fee schedule before you trade, since the rules aren’t the same everywhere.

Fees are typically highest on contracts trading near the middle of the price range and taper off toward the extremes. A contract priced near $0.50 reflects the most uncertainty, so exchanges charge more to facilitate that trade; a contract priced near $0.10 or $0.90 reflects a market that has largely made up its mind, so the fee is smaller.

That structure matters more than it looks. Fees are typically assessed as a small percentage of the contract’s price rather than a flat percentage of your total spend, so the profit margin they eat into shifts depending on where you’re trading. A contract on the Oregon governor’s race at $0.10 has far more room to run if you’re right than one at $0.60 — but a small fee still claims a larger share of that bigger potential profit.

While Portland is a fantastic city for professional sports, Oregon is also an outstanding state for collegiate sports thanks to the prominence of the University of Oregon Ducks and Oregon State Beavers athletic programs. Additionally, the US Ninth Circuit Court of Appeals has made a favorable ruling for Nevada officials in their own dispute with Kalshi.
