Are prediction markets legal in New Jersey?
Yes. United States law makes trading of prediction markets in New Jersey legal under the oversight of the US Commodity Futures Trading Commission. While New Jersey legislators have proposed a bill requiring prediction markets to obtain licensure from the state and pay taxes to New Jersey, that legislation has stalled in committee, although it could see more consideration in the fall of 2026.
New Jersey authorities attempted to enforce state gambling laws against prediction markets like Kalshi in March 2026, arguing that prediction market event contracts connected to in-state collegiate sporting events violate New Jersey law. Kalshi immediately sued to block that action, though, and obtained a preliminary injunction to that effect.
In April 2026, an appeals court upheld that injunction, which will keep prediction market trading legal in New Jersey at least until the court lifts the injunction or a further appeal occurs. New Jersey officials have communicated their intent to appeal the ruling to the US Supreme Court, and the court gave them until Aug. 4, 2026, to file their petition.
NJ prediction market apps reviewed
While all of these prediction market platforms are registered with the Commodity Futures Trading Commission (CFTC) and therefore legal to use in NJ, the various exchanges have different strengths and weaknesses like contract selection, interface usability, and market depth.
- Polymarket: Best sign-up bonus and most rapidly expanding market selection
- Kalshi: Best for consistently high volume on markets for popular events
- FanDuel Predicts: Best for market price comparison and shopping
- OG Predicts: Best for traders interested in crypto and financial markets
- DKeX: Best for experienced sports bettors new to trading
1. Polymarket: Best sign-up bonus and most rapidly expanding market selection
Although Polymarket doesn’t yet boast the dependable market volumes that Kalshi does, Polymarket is offering a $20 bonus in your account when you sign up and make a $10 deposit. For comparison, sign-up offers from Kalshi and OG Predicts come with trading requirements that you must complete within specified time frames after you open your account, whereas with Polymarket, all you have to do is sign up and deposit at least $10.
Another stellar facet of Polymarket’s platform is how quickly it is adding new markets, such as those related to futures and games for the New York Giants and Jets. Polymarket also offers markets related to New Jersey politics like whether Booker will announce that he is running for the 2028 Democratic nomination for president of the United States before 2026 ends.

2. Kalshi: Best app for high volume markets for popular events
Kalshi outperforms all the other operators on this page in terms of reliably having significant trading volume on prominent events in culture and the news, especially in regard to sports compared to DKeX, FanDuel Predicts, and OG Predicts. However, volume at Kalshi on less popular events can lag behind some of those operators.
If you’re interested in trading positions on events like New Jersey Devils games or futures and US Senator Cory Booker’s reelection bid, Kalshi could be the best place to find these markets. For example, Kalshi was offering a market on Booker’s margin of victory in that November 2026 race at the time of this writing.

3. FanDuel Predicts: Best for market price comparison and shopping
We recommend that New Jersey traders keep FanDuel Predicts in their rotation because it does the most out of all the exchanges listed here to give people the choice to view market prices in various formats like dollar amounts, percentages, and even American odds that sports bettors will be familiar with. FanDuel Predicts may not have the best price on every market or volume that can yet compete head-to-head with Kalshi, but it often represents values that traders might miss if they don’t check FanDuel Predicts before trading.
One of the biggest drawbacks of FanDuel Predicts in NJ is that sports event contracts are unavailable on the exchange in New Jersey. Still, FanDuel Predicts provides opportunities to trade markets relevant to New Jerseyans, like markets related to November 2026 elections for New Jersey’s 12 seats in the US House of Representatives.

4. OG Predictions: Best for traders interested in crypto and financial markets
OG Predictions is a product of Crypto.com, making financial markets and contracts connected to cryptocurrencies native to the brand. Although OG Predictions does not offer sports event contracts in NJ like Kalshi and Polymarket do, OG Predictions tops both of those exchanges in terms of the variety and volume of crypto price target contracts and other economics-related markets.
Political markets on OG Predictions relevant to NJ include futures on whether Booker will win the 2028 Democratic nomination for president. OG Predictions also offers mention markets tied to public appearances and social media accounts of New Jersey celebrities such as Anne Hathaway or John Travolta.

5. DraftKings: Best for experienced sports bettors new to trading
DKeX, better known as DraftKings Predictions, does not offer sports event contracts like Kalshi or Polymarket in New Jersey, but it does provide a user experience that will be extremely familiar for people who have experience with traditional online sportsbooks. The functionality and the look are all very similar to the sports betting experience at DraftKings, making it easy for novice traders to get comfortable.
The lack of sports offerings doesn’t mean that New Jerseyans can’t find contracts of particular local relevance on DKeX, either. From political markets like whether New Jersey House seats will flip to weather markets, NJ residents have plenty of contracts to browse.

How to trade prediction markets in New Jersey
If you’ve ever signed up for an online sportsbook in New Jersey, then you’re familiar with the basics of the process of how to register your account with an NJ prediction market. There are some key differences in the registration flow for exchanges, but similar account funding and identity verification steps are crucial.
- Choose an exchange: This is your chance to ensure that you use your money and time wisely, as you should check to ensure that the platform that you want to try is registered with the CFTC and permits trading in NJ. You should also compare fees and the availability of markets like sports contracts for the best value.
- Complete account verification: All of the CFTC-registered exchanges on this page comply with robust verification standards to protect traders’ identities and ensure that trading is equitable.
- Enter the bonus code: While many prediction market exchanges award their new trader bonuses without the use of a bonus or promo code, this is the time to enter such a code if it is necessary.
- Add funds to your account: Each platform maintains unique policies on what forms of payment it accepts in accordance with CFTC rules. Examples include ACH payments, debit cards, and even certain cryptocurrencies in some cases.
- Search for event contracts: When the exchange verifies your account and deposit, you’re ready to search for a market that you like. These contracts consist of “no” and “yes” outcomes and are normally priced between $0.01 and $1.00. The price reflects traders’ view on the probability of the stated outcome, and traders have extensive flexibility in moving in and out of positions.
- Get your earnings: Should your prediction prove accurate, you can withdraw your winnings as real money using the cashier section in the app or website. The amount of time it will take to receive your payment depends on what payment method you select and the policies of the exchange.
Example: Trading on New Jersey Devils futures
After you finish signing up on Kalshi or Polymarket, you might search for contracts related to the New Jersey Devils, such as whether the Devils will win the Stanley Cup at the end of the 2026-27 NHL season.
If you were to buy the “yes” side of that contract at the time of this writing, each position would cost you $0.04. For each position you purchase, your potential return is $1 if your prediction proves accurate.
That means that if you buy into the “yes” side and the Devils win the Stanley Cup as you predicted, your profit would be $0.96 on each contract, as $1.00 – $0.04=$0.96. Because of how prediction markets work, though, you don’t have to wait until the season ends to potentially benefit from your position in the market.
Suppose the Devils acquire a star player or simply get off to a hot start at the beginning of the season. That could result in the price of the contract you’re invested in rising because more people are looking to buy.
If that market price were to rise to $0.44, for example, you could sell at that point and realize a $0.40 profit without running the risk of whether they would actually win the Stanley Cup. You do sacrifice some potential profit this way, but it can prove the wise move to take a more certain profit even if it is smaller.
How fees work at NJ prediction markets
Each exchange operator makes its own policies for fees within the confines of CFTC regulations. In every case, though, fees are how the exchanges make their money.
Some exchanges charge fees on all transactions while others assess fees upon the settlements of contracts. The fees vary not only in terms of structure but cost as well.
Polymarket tends to have the lowest fees of all New Jersey prediction markets. However, it’s worth noting that at all prediction apps in NJ, fees will represent a larger chunk of your potential profits the more valuable those potential profits are.
This is because most fees are structured as either a percentage of settlement amounts or tiered flat fees that rise with settlement values. Polymarket’s 10% fee upon settlement is the best example of this.
Suppose you buy $10 worth of contracts at $0.10 each on Polymarket and your prediction proves accurate. Fees would take up nearly $9.99 of your earnings in that instance.
For contrast, assume that you instead spend that same $10 on contracts that trade at $0.60 each. In that instance, fees would account for just $1.66 of your earnings.
Your profits would obviously be greater on a $0.10 contract than on an $0.60 contract, but you’ll pay a greater share of those earnings to the exchange as well. You can experiment with this balance for the markets you’re considering using DeFiRate’s fee calculator.
Upcoming sports events to trade on in New Jersey
Contracts tied to New Jersey sporting events are some of the most popular at NJ prediction markets like Kalshi and Polymarket. For that reason, they see some of the strongest price fluctuations and are very sensitive to changes in trader perception.
Assume for the sake of example that you’ve bought into the “yes” side of a market on whether the Seton Hall Pirates men’s basketball team will qualify for the March NCAA tournament. Continuing with the example, suppose that the team’s leading scorer suffers a substantial injury halfway through the regular season.
While it’s still possible that your prediction could prove true, traders’ perception of the market is likely to suffer because of that injury. In turn, that means it’s probably not a good time to consider selling your position.
Coaching moves, player transactions, and even excellent or poor performances on the field of play can similarly make prices move. This is a perfect example of how there is always risk involved in prediction markets in NJ.

NJ prediction markets vs. sports betting
There are some similarities between prediction market trading and traditional sports wagering in New Jersey but also pertinent differences. New Jerseyans can compare the two opportunities to get the terms they want on the sporting events that they are interested in.
- Market fees: Sportsbooks make their money by bettors losing their wagers, but prediction markets have no interest in the markets themselves, making their money through fees instead.
- Market flexibility: Some sportsbooks do offer reduced early cash-out options on limited wagers, but in general, the flexibility to exit markets early tends to be much greater with prediction market exchanges.
- Market legality: The CFTC regulates prediction markets in NJ while the New Jersey Division of Gaming Enforcement (NJDGE) oversees traditional sportsbooks.
- Market pricing: While sportsbooks set their lines to try to make money regardless of the outcomes of events, demand for the contracts sets the cost at prediction markets.
- Market structure: With traditional sportsbooks, you’re betting against the house. You’re betting against other traders when you use prediction markets.
The biggest difference between NJ prediction markets and online sportsbooks in New Jersey is that trader perception of events sets the price for event contracts, while with sportsbooks, you either accept the book’s price based on their models or pass on the bet.
What markets can you trade on in New Jersey?
New Jersey prediction markets provide an array of event contracts encompassing a variety of events. Politics and sports are included, but the scope is much larger.
- Cryptocurrency: These markets mostly focus on specific cryptocurrencies hitting specified prices by certain dates. Bitcoin and Ethereum are common inclusions. The best platform for these markets is OG Predictions.
- Culture: The variety in this category is extensive, ranging from the winners of specific Academy Awards to developments in reality television series. You may even find Rotten Tomatoes score contracts for upcoming films. The best platform for these markets is DKeX.
- Economics: Examples of these contracts include interest rate movements, prices for common commodities like gasoline, and jobs reports. There are even markets on Gross Domestic Product statistics which Atlantic City’s casino industry contributes to. The best platform in this regard in NJ is FanDuel Predicts.
- Politics: Events of national interest like which party will control each chamber of Congress after the November 2026 elections are common, but there are also contracts of more relevance to New Jerseyans like the margin by which US Sen. Cory Booker will win reelection. The best platform in this context is Polymarket.
- Sports: Markets in this genre include contracts based on single-game and longer-term outcomes like win totals and player awards. This is where you can find contracts on whether the Jets will win the AFC East division title in the 2026-27 NFL season, for example. The best platform here is Kalshi.
New Jersey-specific rules for prediction markets
As the CFTC regulates NJ prediction market exchanges instead of the NJDGE, as is the case for NJ sportsbooks, the rules for prediction market trading can differ substantially compared to the policies that New Jersey sportsbooks enforce.
The simplest example of this difference is the minimum age to trade versus bet on sports. New Jersey law requires people to be at least 21 years old to bet on sports but CFTC rules allow people to trade event contracts as young as 18.
Another key difference is that prediction market exchanges have greater leeway to establish their own rules in terms of settling contracts whereas the NJDGE has established more robust regulations around settling sports bets. This means that traders need to read exchanges’ policies about contract settlement carefully.
New Jersey lawmakers have suggested taxing the net income of prediction market exchanges, but that legislation (A5336/S4447) has stalled in committee and may not see further consideration until late in 2026. Sportsbooks in NJ pay a 19.75% tax on their gross revenue to the state.
One similarity is that the IRS and the state generally consider prediction market earnings and sports betting winnings to be taxable income. For that reason, you should keep detailed records of their activities in both formats and consult tax professionals to ensure proper payment and reporting.
How New Jersey works between products
The prominence of legal online sports wagering in New Jersey has had several impacts on prediction market exchanges in the state, including determining which exchanges offer sports event contracts. This is because of the disputed legality of sports event contract trading and regulators’ stance on that issue.
For example, Flutter CEO Peter Jackson has stated that FanDuel has refrained from offering sports event contracts on FanDuel Predicts in states where FanDuel Sportsbook operates, like NJ, because it doesn’t want to incur any risk to its sports betting license.
New Jersey is at the forefront of the national debate over whether prediction market exchanges can offer sports event contracts. At this time, New Jersey officials are preparing to file a petition for the US Supreme Court to review the decision of the Third Circuit Court of Appeals affirming a preliminary injunction barring state officials from taking action against Kalshi and other prediction market exchange operators.
National implications are essentially guaranteed if the Supreme Court takes up that case. The Supreme Court’s opinion could affect the CFTC’s role in governing prediction market trading, the legal definition of sports event contracts, and the sovereignty of state and tribal governments over trading occurring within their borders. Numerous state and tribal governments have sued exchange operators for alleged violations of gambling laws in those areas, especially pertaining to sports event contracts.

Things to know before you trade sports & elections in NJ
Because of the legal challenge that New Jersey officials have raised to sports event contract trading in the state and the divide between prediction markets and sportsbooks in NJ, New Jerseyans need to note a few facts.
- Age minimums for sports betting and trading are different: CFTC rules impose a minimum age of 18 years old for trading prediction markets, while New Jersey law establishes a minimum of 21 for gambling, including sports betting.
- Legal sportsbooks remain an option in New Jersey: The presence of some prediction markets offering sports event contracts does not replace or reduce the number of apps and websites offering traditional sports wagering in NJ.
- Litigation can change the status quo quickly: A decision from the US Supreme Court could interrupt or limit access to prediction market exchanges for people in New Jersey, potentially overnight.
- Platform rules can alter traders’ experiences: Exchange operators set unique policies for aspects like contract settlement that not only differ substantially from regulations for sportsbooks but can also vary in comparison to other prediction market exchanges.
- Prediction markets work differently than sports wagers: Contract prices can shift significantly after news breaks and traders retain flexibility in moving in and out of their positions.
- Sports event contracts are not universally available: Several NJ prediction markets like DKeX, FanDuel Predicts, and OG Predictions do not offer sports event contracts to New Jerseyans.
